Fighting Criminal Charges

If you have been arrested for crime it is very important that you contact a qualified lawyer immediately. If you have been retaining a family lawyer you should ask him or her if they have handled cases similar to yours in the past, or if they can refer you to another lawyer who may be more adept at your particular type of criminal case.

Remember that when you do get arrested, you have rights. If you are reading this page, chances are you have already been arrested, but it is still important to remember this for the future. Cooperate with police officers during an emergency situation, and do not lie to officers, but do not volunteer information. Police officers are trained to attempt to get a confession out of a suspect. They will make you believe that if you admit to a crime (or a lesser crime related to the bigger crime) that they will be able to "help you out" and maybe you won't get into any trouble.

Although they are allowed (in most, if not all states, I believe) to imply that they can "help you out" it is important to remember that a police officer is not a lawyer, nor a judge. They do not have the power to offer you deals. You make plea bargains with the prosecuting attorney and a judge, not a police officer. If you do take their offer and admit to a crime, you may find yourself being arrested on the spot. I can't believe how good the police are at getting confessions. All you have to say is "I'm sorry, but I cannot confess to that crime" and "I'm going to wait until I can get legal advice from my attorney." They will often imply that by not confessing you will be in much more trouble. Just keep repeating the line. Their line will usually be: "Look, buddy. You make things a whole lot easier on you and me just by telling me exactly what happened. It's no big deal." Repeat the line.

If you are reading this page, you have probably already been arrested for a crime. Bummer. Now it is important to hire a good lawyer. The court-appointed attorney is free. BEWARE! You get what you pay for. The public defender is often over-worked and under-paid by the state. They might handle 2 dozen other cases on any particular day. Hire someone who can focus on your case. They may cost a lot, but they can save you lots of money in fines and have charges dropped or reduced, so you don't end up with a rap sheet longer than Moby Dick. Who knows, they may even win your case and you'll be able to move on as if nothing had ever happened.
